This data protection and privacy policy (the “Policy”) sets out how Energy Aspects Ltd and its subsidiaries from time to time (together “Energy Aspects”, “we” or “us”) use and protect any personal information that you give to Energy Aspects when you use this website and our services.


Energy Aspects is committed to ensuring that your privacy and personal information is protected. You can be assured that any identifying information you provide to us will only be


 used in accordance with this Policy and relevant data protection legislation. Please note that for some laws (like GDPR), we distinguish between a “controller” and a “processor”. We are a “controller” for those services where we make decisions on how personal information is used in connection with our services, and we are a “processor” for those services where we only use personal information as allowed by our clients. Where we make decisions on how personal information is used in connection with our services (where we are acting as a controller), we are responsible for the obligations of a “controller” under applicable laws in connection with the processing of personal information. Where we only use personal information as allowed by our clients (where we are acting as a processor), our clients are similarly responsible for the obligations of a “controller” under applicable laws in connection with the processing of personal information.


Energy Aspects may change this Policy from time to time by updating this page. You should check this page periodically to ensure that you are happy with any changes. This website is not intended for children and we do not knowingly collect data relating to children.

What do we collect?

We may collect the following information (“Personal Information”):

• Your name and job title

• Contact information including email address and phone number

• Account information including billing information

• User content including content of communications, feedback and comments you send to us

• Location and demographic information

• Technical data about how you access the website and services (e.g. IP address, operating system)

• Usage and browser data on how you use our website, products and services

• Data on your preferences in respect of marketing and communications


How do we use it?

We require your Personal Information to understand your needs and provide you with a better service, and in particular we may use the Personal Information for the following reasons:

• To understand how clients and other website visitors use our services so we can improve them

How do we share it?

Energy Aspects Group


We may share your Personal Information within the Energy Aspects group of companies. Whenever we transfer your Personal Information out of the EEA, we ensure a similar degree of protection is afforded to it by ensuring the following safeguards are implemented:


  • We will only transfer your Personal Information to countries that have been deemed to provide an adequate level of protection for Personal Information by the European Commission.
  • Where we use providers based in the US, we may transfer data to them if we have a Data Processing Addendum in place with such provider which affords the same standard of protection.


In certain circumstances, customers may have Personal Information which is subject to GDPR, which governs “data controllers”, “data processors” and the processing of “Personal Information”, as each term is described therein. Because Energy Aspects cannot independently determine whether and to what extent any Personal Information is subject to European GDPR, if you believe your Personal Information is subject to European GDPR, you should contact Energy Aspects if you would like to enter into a Data Processing Addendum (“DPA”) with us. Energy Aspects and its employees, agents and subcontractors may only access, maintain, use and disclose such Personal Information as permitted by the terms and conditions of the DPA. 


Sub-processors

Energy Aspects engages and uses data processors which may have access to your Personal Information (each a “Sub-processor”) and you hereby give your consent to this sub-processing. Prior to engaging any third-party sub-processor, Energy Aspects performs due diligence to evaluate their privacy, security and confidentiality practices, and executes an agreement implementing its applicable obligations. Energy Aspects has DPAs with all of the Sub-processors it uses.

Energy Aspects may change the above list of Sub-processors at any time. You should check this page periodically to ensure that you are happy with the Sub-processors we use. How long do we use it for?

By law we have to keep basic information about our clients (including contact, identity and transaction data) for six years after they cease being clients for tax purposes. In some circumstances we will anonymise your Personal Information (so that it can no longer be associated with you) for research or statistical purposes, in which case we may use this information indefinitely without further notice to you. 


How do we keep it secure?

We are committed to ensuring that your Personal Information is secure. We have put in place appropriate security measures including suitable physical, electronic and managerial procedures to prevent your Personal Information from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, we limit access to your Personal Information to those officers, employees, agents, contractors and other third parties who have a business need to know. They will only process your Personal Information on our instructions, and they are subject to a duty of confidentiality. Wherever we use software provided by third parties to process your personal information we ensure that these systems also have suitable security arrangements in place. We have put in place procedures to deal with any suspected Personal Information breach and will notify you of a breach and any applicable regulator where we are legally required to do so.

You will not have to pay a fee to access your Personal Information (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we could refuse to comply with your request in these circumstances.


We may need to request specific information from you to help us confirm your identity and ensure your right to access your Personal Information (or to exercise any of your other rights). This is a security measure to ensure that Personal Information is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.


We try to respond to all legitimate requests within one month. Occasionally it could take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.


California consumers

For California based consumers, Energy Aspects does not presently fall in the criteria required for it to be a “business” under the California Consumer Privacy Act of 2018 (“CCPA”) and therefore the CCPA does not apply to Energy Aspects. We continue to monitor our compliance with the CCPA as our business grows.

Recruitment privacy policy

Energy Aspects Ltd and its subsidiaries from time to time (together “Energy Aspects”, “we” or “us”) is committed to protecting and respecting your privacy. This recruitment privacy policy (together with any other documents referred to in this document) (the “Policy”) sets out the basis on which the personal data collected from you, or that you provide to us, will be processed by us during our recruitment processes. Please read the following document carefully, to understand our views and practices regarding your personal data and how we will treat it.


For the purposes of the General Data Protection Regulation (“GDPR”) the Data Controller is Energy Aspects.


We use Workable, an online application provided by Workable Software Limited, to assist with our recruitment process. We use Workable to process personal information as a data processor on our behalf. Workable is only entitled to process your personal data in accordance with our instructions.


Where you apply for a job opening posted by us, this Policy will apply to our processing of your personal information, in addition to our general Privacy Policy.


Your Personal Information

Information we collect from you


We collect and process some or all of the following types of information from you:

• Information that you provide when you apply for a role. This includes information provided through an online job site, via email, in person at interviews and/or by any other method

• In particular, we process personal details such as name, email address, address, date of birth, qualifications, experience, information relating to your employment history, salary details, skills and experience that you provide to us

• If you contact us, we may keep a record of that correspondence

• Details of your visits to our own and Workable’s website including, but not limited to, traffic data, location data, weblogs and other communication data, the site that referred you to Workable’s website and the resources that you access


Information we collect from other sources

Workable provides us with the facility to link the data you provide to us with other publicly available information about you that you have published on the Internet—this may include sources such as LinkedIn and other social media profiles.


Workable’s technology enables us to search various databases, which may include your personal data, to find possible candidates to fill our job openings. Where we find you in this way we will obtain your personal data from these sources.


Uses Made of Your Information

Lawful basis for processing


We rely on legitimate interest as the lawful basis on which we collect and use your personal data. Our legitimate interests are the recruitment of staff for our business.


Purposes of processing


We use information held about you in the following ways:

  • To consider your application in respect of a role for which you have applied
  • To consider your application in respect of other roles
  • To communicate with you in respect of the recruitment process
  • To enhance any information that we receive from you with information obtained from third-party data providers
  • To find appropriate candidates to fill our job openings
  • To help Workable improve their services
  • In connection with any subsequent employment or placement at Energy Aspects


How we store your personal data


Security

We take appropriate measures to ensure that all personal data is kept secure including security measures to prevent personal data from being accidentally lost, used or accessed in an unauthorised way. We limit access to your personal data to those who have a genuine business need to view it. Those processing your information will do so only in an authorised manner and are subject to a duty of confidentiality.


We also have procedures in place to deal with any suspected data security breach. We will notify you and any applicable regulator of a suspected data security breach where we are legally required to do so.


Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted through any online means, therefore any transmission remains at your own risk.


Where we store your personal data

Where we store your personal data in our own systems, it is stored in the European Economic Area (“EEA”). The data that we collect from you and process using Workable’s Services may be transferred to, and stored at, a destination outside the EEA. It may also be processed by staff operating outside the EEA who work for us or for one of our suppliers. Such staff may be engaged in, among other things, the processing of your personal details or the provision of support services. By submitting your personal data, you agree to this transfer, storing or processing.


In particular, your data may be accessible:

• To Workable’s staff in the US or

• Through being stored by Workable’s hosting service provider on servers in the US, as well as in the EU.


The US does not have the same data protection laws as the UK and the EEA. A Data Processing Addendum (“DPA”) has been signed between Workable Software Limited and its overseas group companies, and between Workable Software Limited and each of its data processors. These DPAs are designed to help safeguard your privacy rights and give you remedies in the unlikely event of a misuse of your personal data.

We will not otherwise transfer your personal data outside of the UK or EEA or to any organisation (or subordinate bodies) governed by public international law or which is set up under any agreement between two or more countries.


How long we keep your personal data

We will hold all the data for 24 months. Your personal information will be deleted earlier than this time frame on one of the following events:

• If you delete your personal information or

• If we receive a written request from you asking us to delete it.


Your rights

Under the GDPR, you have a number of important rights. In summary, those include rights to:

• Access to your personal data and to certain other supplementary information that this Policy is already designed to address

• Require us to correct any mistakes in your information which we hold

• Request the erasure of personal data concerning you in certain situations

• Request access to the personal data concerning you which you have provided to us, in a structured, commonly used and machine-readable format and have the right to transmit those data to a third party in certain situations

• Object at any time to processing of personal data concerning you for direct marketing

• Object to decisions being taken by automated means which produce legal effects concerning you or similarly significantly affect you
