Trial terms and conditions

Access to Energy Aspects subscriptions for a trial period is subject to the following terms and conditions ('Trial Agreement'). By accessing Energy Aspects publications you ('Client') agree to be bound by these terms and conditions during the Trial Period.

Energy Aspects hereby grants the Client a personal, non-exclusive, non-transferable, royalty-free, revocable license solely for the purpose of internal trial and evaluation of Energy Aspects publications. Trial subscriptions are offered at the complete discretion of Energy Aspects and no commitment is made to offer a Trial Period for any service or client.

Trial access is given for the purposes of Clients sampling new publications and publications for the Energy Aspects archive. The number of reports that a Client may access and download during the trial period will be limited at the sole discretion of Energy Aspects.

Upon expiration or termination of this Trial Agreement or trial period, unless otherwise instructed by Energy Aspects or unless the Client has purchased a subscription, the Client shall cease all use and shall promptly destroy or return the publications (including all copies).

The Client shall not duplicate, transfer, disclose, provide, distribute, sell, lease, republish, sublicense or otherwise make available Energy Aspects publications, or any part or copies thereof, to any third party without the prior written consent of Energy Aspects. The Client will not remove any copyright, trademark or other proprietary notices. The Client shall not alter, modify, or make derivative works of the publications.

Energy Aspects makes no express or implied representations and warranties as to the merchantability or fitness for a particular purpose or use with respect to any publications or any data included in such publications. The client agrees that Energy Aspects shall not be liable for any loss, claim or damage, to the client or any third party, whether direct or indirect, relating to the client's possession or use of Energy Aspects publications.

If Client breaches any of its obligations under this Trial Agreement, Energy Aspects shall have the right, in addition to any and all legal remedies, at its own discretion:

(i) to terminate the trial subscription immediately upon notice to Client;

(ii) to claim the reasonable value of unauthorized use of the publications from the Client; and

(iii) to be indemnified by the Client against any cost, loss or damage suffered by Energy Aspects including Energy Aspects' legal fees as a result of the said breach or non-compliance.
